Against Age Discrimination

There are laws against age discrimination in modern America. The primary laws are the Age Discrimination Act of 1975 and the Age Discrimination Employment Act of 1967 (ADEA). Both protect individuals from discrimination, one in the public arena and the other in the workplace. The ADEA protects workers 40 years old and older from bias in terms of firing, hiring, promotions, benefits, pension, and more. Under both laws, if someone believes they have been discriminated against, they may file a claim and receive mediation or take their case to civil court. If they can prove their employment claim, they may receive reinstatement, back pay, and even damages. However, the odds against winning a suit against age discrimination from an employer are high.

Fast Facts

  • Over 19,000 age discrimination claims are filed each year in this country. In mediation cases, 80% are settled. In civil court, only 50% are successful.
  • Age discrimination ranks third, behind race and disability, as the most common discrimination claim filed in the US.
