Age Discrimination In The Workplace

Age discrimination in the workplace is a growing problem for workers aged 40 and older. There are more companies seeking to reach the youth market in America, and employers often feel they can do that more effectively with a young staff. However, it is against the law to discriminate against any older worker in hiring, firing, promotions, benefits, pensions, and more. That was legislated in the Age Discrimination Employment Act of 1967 (ADEA). As a result, if anyone believes they have faced discrimination in the workplace, they can file a claim under the ADEA with either a state agency or the federal Equal Employment Opportunity Commission. Mediation is the first option, and it solves approximately 80% of these claims. If it doesn't, the case is referred to a lawyer. The success rate of civil court cases is much lower than the mediation rate, generally around 50%.

Fast Facts

  • The ADEA also protects employees who file age discrimination claims from facing retaliation for their accusation.
  • Employers who are found guilty of age discrimination in the workplace will be required to correct the discriminatory activities and possibly also notify their employees of the claim and its outcome.
