Disability Discrimination Cases

Among the most famous of disability discrimination cases is the story of Pam Huber. Huber was employed by Wal-Mart as an order-filler, making $13 dollars an hour. While on the job, she was injured and was no longer able to perform her previous duties. She reported her disability to Wal-Mart and asked for another position, as a router, within the company. The router position was filled by another employee, who was considered by Wal-Mart to be more qualified, while Huber was given a job as a janitor. The janitorial position paid only $6.20 an hour. Huber sued Wal-Mart, citing the Americans with Disabilities Act, which she contended granted her the right to an equivalent position. The case was to be heard by the Supreme Court, but was settled out of court before it came to trial.
