Federal Housing Discrimination

The Fair Housing Act as well as other civil rights legislation specifies federal housing discrimination law in the United States, making it illegal for landlords, owners, and real estate companies to discriminate when providing housing. The Fair Housing Act is the main legislation, but other federal laws such as the Civil Rights Act also support the same concepts. When housing is being rented, leased, or sold, the housing provider can legally screen the potential buyer/tenant before making a selection. This procedure, known as tenant screening, is completely legal as long as the housing provider does not unlawfully discriminate. Unlawful discrimination includes any action taken on the basis of race, color, sex, disability, or familial status. Under the federal law, individuals who have been discriminated against can file a complaint with HUD to resolve the violation. Resolution in housing discrimination cases may include a hearing, lawsuit, and substantial monetary damages.
