Housing Discrimination Disability

In any type housing transaction, the Fair Housing Act makes it illegal for providers of housing to refuse housing on the basis of a person's disability. Among the many types of housing discrimination, disability refers to actions related to mental or physical impairment, usually of a medical nature. This generally includes conditions such as blindness, deafness, HIV, retardation, addiction, learning disability, or mental illness. If a housing provider has a valid regarding how the discrimination will pose a directly significant threat, discrimination based on disability may sometimes be legal, but should first be confirmed with local housing agencies. Otherwise, housing discrimination based on disability may result in legal ramifications for the provider. On top of the laws outlined in the Fair Housing Act, disabled persons are also protected the Americans with Disabilities Act, a subsection of the Civil Rights Division.
