Religious Discrimination Cases

According to United States law, religious discrimination is unlawful. Religious discrimination is a term that refers to the unfair treatment of of a person on account of their chosen religion. Throughout the years, many religious discrimination cases have resulted from violations in employment, education housing, lending, and public accommodation. For religious discrimination cases to be filed, the issue may need to be filed with the appropriate agency and then taken to court, where charges will arise and damages are determined.

In Reynolds c. United States, a 1878 Supreme Court Case, it was held that religious duty was not defense for criminal activity. In 1990, after the case of Westside community Board of Education V. Mergens, the US Supreme Court found that students have right to engage in extracurricular religious clubs at school. Many other religious discrimination cases have also taken place more recently, including Locke v. Davey (2003),Bronx Household of Faith v. Board of Education of the City of New York (2003, and Midrash Sephardi v. Village of Surfside (2004).
