What action can I take if my family member has endured physical abuse while serving a prison sentence?

My brother is currently serving a sentence for a felony at a correctional institue.  Recently he said the prison guards have subjected him to physical abuse.  Do I have any form of recourse?

Many people believe that simply because one is imprisoned he has lost his right to sue.  This is not true.  Simply because one has lost certain rights, he still enjoys basic human rights, including the right to be free from physical abuse.  Physical and psychological abuse is prohibited and provides grounds for a lawsuit.

If your brother is suffering abuse, you could contact a civil rights attorney and investigate the possibility of bringing a lawsuit against the correctional institute.  A civil rights attorney will be able to determine whether a cause of action exists for your situation.
