Sexual Orientation Discrimination

Gay, Bisexual, Transgender or Heterosexual Discrimination? This discrimination about who someone chooses to have sex relations with. The federal government issued an executive order in 1998 that prohibits sexual orientation prejudice in civilian employment. Unfortunately, this does not apply to the private sector. Currently, seventeen states have laws protecting this class of people in our society from prejudice.

Some types of sexual preference discrimination include:

  • Termination at the workplace
  • Harassment
  • Denial of job opportunity
  • Denial of partner health insurance
  • Denial to be able to rent an apartment
  • Issues at school

Whether lesbian (discrimination against woman), gay, bisexual, or straight (heterosexual), and living in one of these states that do not recognize or address this type of discrimination, our civil rights lawyers can still peruse sexual harassment based on orientation. Many of these cases are on the rise today in our court system and the pursuit for equal civil rights for all individuals will prevail.

Most people when thinking about sexual preference discrimination most think about people who like the same sex are the ones being discriminated against. Yet, matters such as these also occur for heterosexuals trying to excel in the many industries controlled by gays and lesbians. Many employees suffer discriminatory acts at work.

Many state and local municipalities protect lesbian and gay workers from prejudice. The states with laws that protect against sexual orientation in the workplace include:  California, Connecticut, Hawaii, Illinois, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Hampshire, New Jersey, New Mexico, New York, Rhode Island, Vermont, Washington, and Wisconsin.

Another area of this type of prejudice may occur while applying for an apartment. Know your renter’s rights! Landlords may be violating state and federal laws by not renting to a gay, lesbian, or straight person. The landlord’s personal beliefs may violate federal law for not renting to same sex couples based on religion. Also it is the same for gay and lesbian landlords not renting to straight couples.
